Merchant Terms

For businesses that show partner offers on their confirmation pages and emails. These terms add to the Terms of Service; the Terms of Service control if they conflict.

1. Your consent and notice duties

You are solely responsible for having a lawful basis to send customer information to Munja and for the notices you give your customers. In particular, you will:

  • Tell customers, in your own privacy notice and before or when you collect their information, that you share their name, email and the order details you choose with Munja to show them offers from other businesses.
  • Obtain any consent the law requires for that sharing in the places where your customers live.
  • Show offers only after a completed order or booking, and only to the customer who placed it.
  • Send only accurate customer details: name, email and the order details you choose. Do not send phone numbers, payment card or bank details, government ID numbers, health information, biometric information, or information about anyone under 18. Munja discards phone numbers it receives.
  • Not change, cover or imitate an offer, its button, or the consent line next to the button. That line states exactly what is shared, and the customer's choice is recorded against it.
  • Not present a partner offer as your own personal endorsement unless it is, and make any disclosure the FTC Act and the FTC's Guides Concerning Endorsements and Testimonials require, including that you are paid when a customer chooses an offer.

2. Your control

You approve each partner before its offers appear on your pages, and you can remove a partner, pause a placement or turn Munja off at any time. Munja does not guarantee any partner or offer (see section 3 of the Terms of Service), and you are responsible for the partners you approve.

3. Earnings and payouts

  • You earn 80% of the price a partner pays when your customer chooses its offer, unless a signed order form says otherwise. Munja keeps the rest.
  • Earnings are paid monthly, on the 1st, for the month before, through Stripe Connect, once Stripe has verified your account. You must accept Stripe's Connected Account Agreement. Balances under $25 roll over to the next month.
  • Partners can ask for a refund on a lead for 14 days after it arrives, so a lead you were paid for may later be refunded (section 4). Munja may hold payouts while it investigates suspected fraud, a breach of these terms, a refund request or a chargeback.

4. Refunds, chargebacks and clawback

If a partner's lead is refunded (for example a duplicate, a fake contact, a test, or suspected fraud), if a partner's payment is charged back or reversed, or if a lead was generated by fraud, self-dealing, bots or any breach of these terms, your share of that lead is reversed. If it was already paid out, Munja may deduct it from your next payouts, reverse the transfer through Stripe Connect where Stripe allows, or invoice you, and you will repay it within 30 days.

5. Indemnity

In addition to section 10 of the Terms of Service, you will defend and indemnify Munja against any claim that you lacked a lawful basis or notice to share customer information with Munja, or that your pages, emails or customer communications broke the law.
